1. Agreement

These Terms of Service ("Terms") are a contract between you and CaperTech S.R.L., Carr. de Mendoza 219, Santo Domingo Este, Dominican Republic ("PlaniCaper", "we", "us"), and govern your use of the website planicaper.com and the PlaniCaper platform (the "Service"). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service. If you use the Service on behalf of a company, you confirm that you are authorized to accept these Terms for it.

2. The Service

PlaniCaper is a social media management platform. It lets you connect your social accounts, create posts with or without the help of AI, schedule and publish them to the accounts you select, and view information about your accounts and posts. Features vary by plan and may change over time.

3. Eligibility

You must be at least 18 years old and able to enter into a binding contract.

4. Your account

• Give accurate information and keep it up to date.
• Keep your password secure and do not share your login. Each person must use their own account.
• You are responsible for everything done through your account. Tell us immediately at support@planicaper.com if you suspect unauthorized use.

5. Plans and payments

• The plans, their prices in US dollars and their limits are shown on the pricing page and before you pay. The Free plan has no cost and has its own limits.
• Paid plans are prepaid for 30 days (monthly) or 365 days (yearly) and are paid through PayPal.
• Plans do not renew automatically and we never charge you without your action. To keep a plan, buy a new period: if you buy the same plan while it is active, the new period is added after the current one.
• If you buy a different plan while one is active, the new plan starts immediately and replaces the current one. Unused time of the previous plan is not carried over or refunded.
• When a paid plan expires, your account, content and connected accounts are kept, but scheduled posts are not published and plan features are unavailable until you buy a plan again.
• Monthly limits, such as posts or AI credits, reset at the start of each calendar month. Unused allowances do not carry over.
• Payments are non-refundable, except where the law requires otherwise.
• We may change prices or plan features. Changes do not affect a period you have already paid for.

6. Your content

You keep all rights to the content you create, upload or publish with the Service. You give us a limited, non-exclusive license to host, store, process, reproduce and transmit that content only as needed to provide the Service: for example, to publish it to the accounts you select at the time you choose, or to send it to our AI providers when you use an AI feature. You confirm that you have the rights needed to publish your content and that it does not infringe the rights of others or the law.

7. Third-party platforms

To publish on a social network you must connect your account and follow that platform's rules. When you use PlaniCaper with them, you also agree to their terms, including:

• YouTube: by using PlaniCaper's YouTube features, you agree to be bound by the YouTube Terms of Service. Google's handling of your data is described in the Google Privacy Policy.
• TikTok: the TikTok Terms of Service, the Community Guidelines, the Music Usage Confirmation and, if you publish branded content, the Branded Content Policy.
• Facebook and Instagram: the Facebook Terms of Service, the Instagram Terms of Use and Meta's policies.
• LinkedIn, X and Telegram: the LinkedIn User Agreement, the X Terms of Service and the Telegram Terms of Service.

PlaniCaper is an independent service. It is not affiliated with, endorsed by or sponsored by Google, YouTube, TikTok, Meta, LinkedIn, X or Telegram. These platforms may change, limit or stop their services and APIs at any time, set their own posting limits, restrict the visibility of content published through third-party apps, or suspend accounts. We are not responsible for those decisions, and some features may stop working as a result.

8. AI features

The AI features (provided through Anthropic and Fal.ai) generate suggestions that may be inaccurate, incomplete or similar to content created for others. Review every result before publishing: you are responsible for what you publish. Do not use the AI features to create unlawful, deceptive or harmful content, or content that infringes the rights of others.

9. Acceptable use

You must not use the Service to:

• Publish content that is illegal, deceptive, hateful, harassing, sexually explicit involving minors, or that infringes intellectual property or privacy rights.
• Send spam or artificially inflate engagement, or break the rules of any connected platform.
• Access accounts or data that are not yours, or publish on accounts you are not authorized to manage.
• Attempt to break, overload, reverse-engineer or bypass the security or the limits of the Service.
• Resell or give access to the Service to third parties without our written permission.

10. Availability and changes

We work to keep the Service available, but we do not guarantee that it will be uninterrupted or error-free, or that every post will be published at the exact scheduled time. We may add, change or remove features. Features marked as beta may be limited or change without notice.

11. Suspension and termination

We may suspend or close accounts that break these Terms, put the Service or other users at risk, or engage in fraud, telling you the reason when the law and the circumstances allow it. You may stop using the Service at any time. To delete your account and your data, write to support@planicaper.com from the email address of your account; we will do it within 7 days, as described in the Privacy Policy.

12. Disclaimer

The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

13. Limitation of liability

To the extent permitted by law, PlaniCaper is not liable for indirect, incidental, special or consequential damages, loss of profits, data or reputation, or for the actions of third-party platforms. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the event that gave rise to the claim. Nothing in these Terms limits rights you have under mandatory consumer protection law.

14. Indemnity

You agree to compensate PlaniCaper for claims by third parties arising from your content or from your breach of these Terms or of the rules of a connected platform.

15. Governing law and disputes

These Terms are governed by the laws of the Dominican Republic. Any dispute will be submitted to the competent courts of Santo Domingo, Dominican Republic, unless mandatory law gives you the right to go to the courts where you live. Before starting a claim, write to us so we can try to resolve it.

16. Changes to these Terms

We may update these Terms. We will publish the new version on this page with a new date and, if the change is significant, notify you by email or inside the Service before it applies. If you keep using the Service after the change applies, you accept the new Terms.
